PROFESSIONAL PROFILE:
MICHAEL J. SWEEDLER specializes in the procurement, analysis and litigation of patents involving diverse technologies including telecommunications, medical devices and food products.
Mr. Sweedler has represented clients including such well known
companies as Wyeth, C.R. Bard, The Topps Company and Nokia.
Mr. Sweedler is often called upon to provide opinions on
infringement and/or validity of patents involving complex electronic
and mechanical technologies. He has served as an expert witness and
currently supervises and assists in the prosecution of patents for
leading manufacturers of antennas, photographic equipment and
medical devices.
He has obtained basic patents in the fields of plastic bags and
signage for small companies and then successfully asserted the
patents to prevent competitors from copying the patented products.
Mr. Sweedler has also obtained the basic patents in quadraphonic
sound and assisted his client in a successful licensing program in
which all manufacturers of quadraphonic equipment accepted licenses.
In a contested litigation, Mr. Sweedler obtained a judgment in favor
of the plaintiff on a patent covering the basic electrode used in
fetal monitoring. He was lead counsel for a major pharmaceutical
company in a false advertising case brought against the company and
successfully defended against a preliminary injunction motion which
would have caused the interruption of a major advertising campaign.
Mr. Sweedler was also lead counsel in an action brought against a
major manufacturer of cellular telephones before the International
Trade Commission.
Mr. Sweedler represented the licensee in the frequently cited
Mahurkar Double Lumen Hemodialysis Catheter Patent Litigation and
presented the damages theory on lost profits which was ultimately
adopted by the District and Appellate courts.
Mr. Sweedler also represented one of the country's leading
manufacturers of contemporary furniture in successfully arguing the
patentability of a furniture design before the United States Court
of Customs and Patent Appeals.
