Leason Ellis Maintains and Even Lowers some rates in intellectual
property matters
WHITE PLAINS, NEW YORK — Following a year in which the firm
continued to expand its business and client base by offering
competitive pricing, Leason Ellis has decided not to raise its rates
for 2010. Some attorneys at the firm have even reduced their hourly
billing rates. In fact, the firm as a whole has not increased its
fees since forming in 2008.
David Leason, Managing Partner of the firm, states, “when we opened
our doors, we decreased our rates about 20% from our prior practice
in Manhattan. Our commitment to keeping our rates affordable to our
clients remains unchanged.”
This stands in stark contrast to the position taken by most other
firms. According to the legal web site
Law.com , about 90
percent of the firms that responded to its survey said that were
increasing rates in 2010.
In this difficult economic environment, many clients are looking for
certainty as to costs. Peter Sloane, Chairman of the Trademark and
Copyright Practice Group at Leason Ellis, states “we have flat rates
for many patent, trademark and copyright charges so that clients can
budget their costs in advance. Unlike many other firms, we also do
not charge for routine administrative expenses like postage, copying
and faxing.”
Leason Ellis has seen significant growth over the past year. The
firm has taken on additional office space and added several
attorneys and staff. Intellectual Property Today magazine listed
Leason Ellis among the top patent and trademark firms in the U.S.
for 2009.

Christopher J. Capelli, an intellectual property attorney with

Yuval Marcus has written an article titled “In re Bose Corporation
- The Federal Circuit Overturns the Standard for Fraud in Trademark

Yuval H. Marcus, formerly of Gottlieb, Rackman & Reisman, Joins the
Firm
WHITE PLAINS, NEW YORK - (June 10, 2009) - Yuval H. Marcus, an intellectual
property litigator with 15 years of experience, has joined Leason Ellis,
LLP, the largest IP law firm based in White Plains, the county seat
of Westchester County, New York. Mr. Marcus is Co-Chair of the Intellectual
Property Committee of the Westchester County Bar Association and a Co-Chair
of the IP Committee of the Westchester/Southern Connecticut Chapter
of the Association of Corporate Counsel.
Mr. Marcus joins the firm as Partner and will focus on litigating patent,
trademark, trade dress, copyright and trade secret cases in federal
court; Uniform Domain-Name Dispute-Resolution Policy proceedings in
the World Intellectual Property Organization; and oppositions and cancellations
in the United States Patent and Trademark Office.
A seasoned litigator, Mr. Marcus counsels domestic and international
clients on how to utilize effective strategies to strengthen intellectual

LEASON ELLIS TAKES ON ADDITIONAL SPACE
As part of its ongoing expansion effort, the firm has sublet additional
space in its building at 81 Main Street in White Plains. The new space
has a suite of offices, a conference room, and open work space. While
other firms are retrenching, Leason Ellis continues to grow apace. Peter
Sloane explains: “we are taking advantage of present market conditions

The May 2009 edition of Intellectual Property Today magazine lists
Leason Ellis among the top trademark firms in the U.S. The ranking is
all the more impressive given the fact that the firm has just celebrated
only its first anniversary. According to Peter Sloane, Chairman of the

LEASON ELLIS OBTAINS TRO AND CONSENT JUDGMENT FOR HONEYWELL
On April 20, 2009, we obtained a Temporary Restraining Order in
federal court on behalf of client Honeywell International Inc. against
a former licensee to prohibit the sale of unauthorized Honeywell branded
televisions in the U.S. After obtaining the TRO, we successfully negotiated
with the Defendant for entry of a Consent Judgment, which included monetary
damages and a permanent injunction.

DAVID LEASON TO SPEAK ON DESIGN PATENT ISSUES
David Leason will be speaking on a panel titled "Design Patents
After Egyptian Goddess" presented by the Patent Law Committee of the
Intellectual Property Law Section of the New York State Bar Association.
The discussion will be held on Thursday, May 7, 2009 from 12:00 p.m.
to 2:00 pm at Thomson CompuMark/Thomson Reuters at 530 Fifth Avenue,
7th Floor, in Manhattan. The panel will focus on the Federal Circuit's
seminal decision in Egyptian Goddess, Inc. v. Swisa, Inc. and its effect
on the field of design patents, including a review of the issues leading
up to the decision in Egyptian Goddess, the significance of that decision
on design patent law and practice, a review of the subsequent decisions
applying the holding in Egyptian Goddess, and practical considerations
in the preparation and enforcement of design patents taking into account
the current state of design patent law.

PETER SLOANE SECURES VICTORY FOR NOVARTIS IN TRADEMARK OPPOSITION
Peter Sloane represented Novartis AG in a win against Cera Products,
Inc. in an opposition before the Trademark Trial and Appeal Board. Novartis,
owner of the well-known THERAFLU cold and cough preparations, opposed
registration of the mark CERAFLU for an oral hydration powdered nutritional
supplement. In upholding the opposition and denying the registration,
the Board held that the mark CERAFLU is confusingly similar with the
mark THERAFLU, which the Board found to be a “distinctive, strong and

BRANDING
Peter S. Sloane has

PETER S. SLOANE PUBLISHES NEW ARTICLE ON COPYRIGHT AND INTERNET LAW
A new article by Peter Sloane appears in the February 15, 2009 edition
of Computer Law International (CRi), a Journal of Information Law and
Technology published in Germany. The article, titled “Reviewing U.S.
Copyright Law and the Internet in 2008,” discusses cases dealing with
a wide variety of issues from takedown notices under the Digital Millennium
Copyright Act, to the first sale doctrine in copyright law, to distribution
rights under the Copyright Act, to the fair use defense.
